Privacy Policy
This privacy statement describes what types of personal information that is necessary for identification we collect and utilize, why we do that and in which cases we disclose it. The statement also describes how you can contact our Privacy Officer with any inquiries or to exercise your rights under the Privacy Laws, which include in particular your right to have access to your Personal Data and the right to correct this information.
To Whom This Privacy Statement Applies and What It Covers?
This privacy statement applies to the customers of The HVAC Service. We respect our clients’ rights to personal privacy, since safeguarding any Personal Data we obtain has always been our priority. We are dedicated to full compliance with the privacy laws relating to our business. These privacy laws appear from the Personal Information Protection and Electronic Documents Act (Canada), the Personal Information Protection Act (British Columbia), the Personal Information Protection Act (Alberta) and the Act respecting the protection of personal information in the private sector (Quebec).
This privacy statement sets out the procedure we collect, handle, store and protect personal data when:
- we provide or discuss our products or services with our clients (current, former and prospective);
- you use our website;
- we perform other business activities.
This privacy statement also includes information in which cases we share your Personal Data with third parties.
What Types of Personal Data Do We Collect, and Why?
We collect our clients’ Personal Data in the course of providing products or services or discussing possible products or services we may provide. We may also collect our clients’ Personal Data when they use The HVAC Service website or through other digital interactions.
We might collect such Personal Data because a customer provides us with it (for example, on the website or in a customer agreement), other people provide us with that Personal Data (for example a third-party dealer). Also, such Personal Data can be obtained from public sources.
We may also collect or obtain personal data from a customer because we observe or infer that data from the way a customer interacts with us or others (see “Use of Cookies” below).
We may collect the following Personal Data:
- your name;
- address;
- telephone number;
- e-mail address;
- age;
- date of birth;
- gender;
- employment details (for example, place of work);
- your IP address;
- your browser type and language;
- your access times;
- details of how you use our products and services;
- details of how you like to interact with us and other similar information.
We also collect banking and/or credit card data from clients who buy, rent, subscribe or otherwise receive our products and services if payments are to be debited directly from such a client’s bank account or applied to their credit card. If we are proposing to extend credit to a customer, we may obtain and refer to a consumer report from a credit or consumer reporting agency containing credit information and other Personal Data. We also keep records of the customer’s use of our products and services.
Our primary purposes in collecting and using Personal Data are to provide you with our products and services, to administer your accounts, and to provide you with support services (for example, maintenance).
During our interactions with customers, we may monitor and/or record your conversations with our representatives for our mutual protection, for training and analytics purposes & to enhance and customize the overall customer experience. We may also use Personal Data collected via our website to manage and improve our websites, to tailor the content of our website to provide you with a more personalized experience and focus your attention to information to our products and services that may be of interest to you and to manage and respond to any request you submit via our websites.
We may also use Personal Data to inform our customers of new products and services we feel may be of interest to them, or to ask their opinions. But, we are obliged to stop doing that at the customers’ request.
Use of Cookies
We may monitor and/or record your browsing habits, at times using the tracking software in the form of “cookies”, when you are browsing our website. Cookies are text files containing unique identification numbers identifying your Internet browser. These cookies enable us to collect/store data (date, time and duration of the visit to our website; recognize returning customers; collect and store geographic data determined by the IP address of your computer; the website from which you linked to our website; and the pages you visited while on our website and how long you stayed). We may also get information about your browsing history from the third parties (our trusted business partners and vendors). All this information is used to enhance the overall user browsing experience.
If you are against using cookies, you can manage and control them through your browser. You can remove them by deleting them from the cache.
Please note that even if you opt-out of interest-based advertising by a third party, these tracking technologies may still collect data for other purposes, including analytics, and you may still see ads from us but the ads will not be targeted based on behavioural information.
The Legal Grounds for Collecting, Storing and Using Your Personal Data
We collect, utilize and disclose our customers’ Personal Data only with their consent (except as otherwise permitted or required by law). A client may give consent explicitly or implied. “Explicitly” means signing a consent form. “Implied” means providing information necessary for a service
To Whom Do We Disclose Personal Data?
The HVAC Service will not disclose Personal Data to third parties unless you authorize us to release it, or release is required or permitted by law.
We share Personal Data among The HVAC Service and with suppliers who offer and perform services on our behalf (such as analytics, data hosting, processing, marketing) and with whom contracts have been signed to optimize providing potential customers with our products and services. We share information only with Canadian suppliers.
We also share data with our dealers with the aim of handling any complaints or problems. We also provide information on our interactions with customers to credit bureaus, financial institutions, and reporting agencies in order to maintain a client’s credit history. Also, our clients’ Personal Data may be revealed at the request of the governmental institutions if it doesn’t preclude the national legislation.
Protection of Your Personal Data
We utilize a chain of physical, electronic and managerial measures designed to keep your Personal Data secure.
The measures provide:
- education and training to relevant staff to ensure they are aware of our privacy obligations when handling Personal Data;
- administrative and technical controls to restrict access to Personal Data to those who require it to fulfil the purposes above;
- technological security measures, including firewalls, multi-factor authentication, encryption and anti-virus software; and
- physical security measures.
We take security measures to protect our customers’ Personal Data. However, remember no security measures can ensure absolute security.
How Long Are Your Personal Data Kept?
The file with your Personal Data will be stored on our servers or those of our service providers. It will be accessible to authorized Team Members. In some cases, we can sore your Personal Data for a more extended period:
1) as long as is necessary for us to provide products and services to you;
2) any retention period required by national law;
3) during the period in which investigations might arise concerning products or services.
Further, any copies of Personal Data stored in our electronic system will be destroyed.
